By accessing or using the Wallet Backend Provider (the "Service"), provided by Web3 Digital Wallet, a simplified joint-stock company (SAS), SIREN 910 399 435 (RCS Chartres), with its registered office at 112 Rue des Tuileries, 28260 Saint-Ouen-Marchefroy, France ("Web3 Digital Wallet"), you ("User" or "Customer") agree to abide by and be bound by these terms and conditions. If you do not agree with these terms, you must refrain from using the Service.
The Service provides organizations and companies with a platform to create, manage, and customize their digital wallets for handling verifiable credentials (VCs) through mobile and web interfaces. Users can configure branding, security settings, SSI profiles, issuer marketplace options, user management, and more according to the features available.
The Service is offered to two categories of users:
Access to the Service requires registration and account creation. You must provide accurate and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
The Service grants the User a non-exclusive, non-transferable license to use the platform solely for the purposes of configuring and managing digital wallets within the organization.
Any form of resale, sublicensing, or redistribution is strictly prohibited unless expressly authorized under a separate agreement with Web3 Digital Wallet.
The Service allows you to upload and configure various elements, including logos, titles, colors, and descriptions, for wallet customization. You are responsible for the accuracy and appropriateness of this content. You must ensure that no content uploaded infringes upon the rights of third parties or violates any applicable laws.
You agree not to:
The Service includes a comprehensive user management system allowing organizations to add, modify, and suspend user accounts associated with their organizational wallets. As an Administrator, you can also define user roles, grant permissions, suspend wallets, and manage access rights.
Users of the Service can be assigned different roles, such as Legal Representative, Administrator, Employee, Manager, or Support. It is the responsibility of the Customer to ensure that roles and permissions are assigned accurately and reviewed periodically to prevent unauthorized access or data misuse.
Administrators have the right to suspend or reactivate wallets based on internal policies or for security reasons. The suspension of a wallet will temporarily prevent the associated user from accessing or presenting verifiable credentials until the wallet is reactivated.
The Service processes data provided by Users to configure and customize wallet settings. Users must ensure that any data uploaded complies with relevant privacy regulations, including the EU General Data Protection Regulation (GDPR). We take appropriate measures to protect your data from unauthorized access, but the security of transmissions via the internet cannot be guaranteed.
All personal data and configuration settings are stored in compliance with European data protection regulations. We implement industry-standard encryption and security protocols to safeguard data integrity and confidentiality.
For international users outside the EU, data processing will comply with applicable regulations in the region where the data is being processed. Users must ensure that any international transfer of data complies with local regulations and that adequate safeguards are in place.
Users have access to the following customizable features within the Service:
For Paid Users, Web3 Digital Wallet will provide a minimum notice period of 60 days for any discontinuation of the Service. This notice period allows Paid Users adequate time to adjust their usage or terminate the Service.
For Evaluation Users, the Service may be updated, modified, or discontinued at any time without notice, as evaluation access is provided on a temporary basis and may be subject to frequent updates.
All intellectual property rights in the Service, including but not limited to software, documentation, and design, remain the property of Web3 Digital Wallet or its licensors. Users are granted no ownership rights to any part of the Service.
The Service is provided on an "as is" and "as available" basis. Web3 Digital Wallet does not warrant that the Service will be uninterrupted or error-free. This disclaimer does not affect any statutory warranties that cannot be excluded under applicable law.
The maximum liability of Web3 Digital Wallet for Paid Users shall be limited to the amount paid by the User for the Service in the 6 months preceding the event giving rise to the claim.
Evaluation Users are provided the Service "as-is" with no warranties, and Web3 Digital Wallet shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Service.
Web3 Digital Wallet shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or revenue, arising from third-party actions, hacking, or factors beyond its control.
We may terminate or suspend your access to the Service at our sole discretion, without prior notice, if you violate these Terms or engage in any conduct deemed harmful to the Service or other users.
These Terms shall be governed and construed in accordance with the laws of France. Any disputes arising out of or in connection with the use of the Service shall be subject to the exclusive jurisdiction of the courts in France.
We may amend these Terms at any time by posting the updated terms on our website or through the Service interface. Continued use of the Service following any such amendments constitutes your acceptance of the new terms.
